Our construction litigation practice is dedicated to helping clients navigate these challenges effectively. We have represented owners, developers, contractors, subcontractors, lenders, consultants, and suppliers in various types of construction-related disputes, including but not limited to:

• Breach of Contract: Resolving disputes arising from contract breaches, non-performance, unjust enrichment, or defective construction work.

• Construction Defects: Assisting clients regarding claims pertaining to faulty workmanship, substandard materials, violations of the Building Code Act, 1992, or failing to meet accepted industry standards.

• Payment Disputes: Advocating for clients in invoice disputes, change orders, disputed amounts, and issues regarding prompt payment, as outlined in the Construction Lien Act, R.S.O.1990 c.30.

• Delay and Disruption Claims: Handling claims involving project delays, disruptions, scheduling conflicts, and acceleration demands.

• Insurance and Bond Claims: Providing guidance on insurance coverage and pursuing or defending claims under performance bonds, payment bonds, or other surety bonds.

• Mediation, Arbitration, and Litigation: In addition to litigation in court when necessary, alternative dispute resolution processes in relation to construction law may be available, including negotiation, mediation, arbitration.
